On September 15, 2023, Plaintiffs filed an Amended Complaint, adding Sherly Barnes as a plaintiff and Capital One Financial Corporation as a defendant. Barnes seeks to represent the national Class as well as a subclass of Capital One 360 Savings accountholders in Massachusetts. Barnes asserts claims of breach of contract, a violation of state consumer protection law, unjust enrichment, and promissory estoppel.
Like Savett, Barnes maintained a 360 Savings account, which she believed would pay her a high interest rate. Barnes was similarly unaware that Capital One had begun offering a new online savings account that paid substantially higher interest than what she reasonably expected Capital One would pay her. Barnes estimates she lost over $8,000 in interest payments before she discovered Capital One’s scheme.
