Settlement Details: The Parties have reached a settlement in the amount of $4.4 million (plus Streamlabs will be paying the costs of notice and administration) which was preliminarily approved by the Court on August 29, 2024.  The Court has scheduled a final approval hearing for January 30, 2025.

Wolf Popper LLP represents the plaintiff in this consumer class action lawsuit alleging that Defendant Streamlabs LLC enrolled and charged consumers for an automatically renewing “Streamlabs Pro” subscription without their consent.

Streamlabs is a company that offers live streaming software that enables video streamers to broadcast their live stream on platforms such as YouTube and Twitch, and to monetize their broadcasts by collecting donations from viewers through third-party payment processors such as PayPal. Consumers across the country often get unknowingly signed up for the Streamlabs Pro auto-renewal subscription when they donate to streamers through Streamlabs and add a GIF or effect to that one-time donation. The complaint alleges Streamlabs failed to make consumers aware of their enrollment and the automatic renewal nature of the Streamlabs Pro subscription, and failed to obtain consumers’ affirmative consent to enrollment and ongoing charges. As a result, donators have ended up with recurring charges on their credit or debit cards, or on their PayPal accounts, for months or even years without realizing it—even if they did not have an account with Streamlabs.

Plaintiff, individually and on behalf of all others similarly situated, alleges that Streamlabs’ conduct has violated the Consumer Legal Remedies Act (“CLRA”) and Unfair Competition Law (“UCL”). The case is pending in the United States District Court for the Northern District of California.
