On October 19, 2023, Wolf Popper LLP filed a Second Amended Complaint in federal district court in Virginia to add Samuel Hans. Hans seeks to represent the national Class as well as a subclass of Capital One 360 Savings accountholders in Illinois. Hans asserts claims of breach of contract, a violation of state consumer protection law, unjust enrichment, and promissory estoppel.
Like Savett and Barnes, Hans maintained a 360 Savings account, which he believed would pay him a high interest rate. Hans was similarly unaware that Capital One had begun offering a new online savings account that paid substantially higher interest than what he reasonably expected Capital One would pay her. Barnes estimates she lost over $1,000 in interest payments before he discovered Capital One’s scheme.
