On June 24, 2024, the Federal District Court for the Eastern District of Virginia appointed Wolf Popper partner Chet Waldman as Plaintiffs’ Lead Counsel and Interim Class Counsel for the Class and Subclasses in In re: Capital One 360 Savings Account Interest Rate Litigation. In this multidistrict action against Capital One, Wolf Popper LLP represents plaintiffs from 18 states who seek to represent both a nationwide Class of Capital One 360 Savings accountholders and subclasses from each state. The lawsuit concerns Capital One’s failure to disclose to its 360 Savings accountholders that it would no longer pay them a “high interest” rate on their savings because Capital One had furtively and unfairly introduced a new online savings account that paid a substantially higher rate. Plaintiffs asserted claims of breach of contract, violations of consumer protection statutes, unjust enrichment, and promissory estoppel. As lead counsel, Chet and Wolf Popper LLP will coordinate discovery and pretrial proceedings.
