Wolf Popper LLP was designated by the United States District Court for the District of Massachusetts to be co-lead counsel in this nationwide consumer class action, In re TJX Companies Retail Security Breach Litigation. The suit sought damages for millions of consumers whose personal information was stolen. The action involved allegations that TJX breached its duties owed to its customers by failing to maintain adequate computer data security.
 
A settlement was reached in 2008 valued at over $200 million.  Settlement benefits included: (i) two years of credit monitoring and identity theft insurance offered to the 455,000 individuals whose driver’s license and other ID numbers were exposed; (ii) a $17 million fund offered to the 45 million cardholders to reimburse identity theft losses, out of pocket costs, and lost time to mitigate or correct actual or potential identity theft; and (iii) injunctive relief regarding improvements to TJX’s data security systems.  These elements became the template for many subsequent data breach settlements. The Court approved the settlement of the case on July 15, 2008, stated that Plaintiffs’ counsel achieved an “excellent settlement” for the consumer class, that they “have been very creative” and performed “a wonderful job.”
