Wolf Popper LLP has brought a putative class action against Natera, Inc., which is currently pending in the United States District Court for the Northern District of California.
The lawsuit alleges that the company’s billing practices are deceptive to consumers. Natera provides genetic testing services for women and couples who are pregnant or wish to become pregnant, including the “Panorama,” “Horizon,” “Vistara,” and “Spectrum” tests. The class action complaint alleges that Natera withholds the true price it intends to charge for these tests, even though it claims to offer “price transparency.” Instead, the complaint alleges that Natera falsely tells patients and providers that the out-of-pocket cost for these tests will not exceed $249. However, patients are later hit with exorbitant surprise bills that are hundreds or even thousands of dollars higher than this amount. The complaint seeks certification of a class of all persons in the United States who had a “Panorama,” “Horizon,” “Vistara,” or “Spectrum” test performed by Natera, and were then billed more than $249 for that test (the “Class”), as well as a Subclass of affected individuals from the State of Florida. The complaint brings claims for violations of the California Unfair Competition Law (“UCL”), the California Consumer Legal Remedies Act (“CLRA”), and common law, as well as violations of the Florida Deceptive and Unfair Trade Practices Act on behalf of the Florida Subclass. The complaint seeks refunds for patients who have been overbilled or overcharged by Natera, and demands that Natera cease its allegedly unlawful conduct.
Natera answered the amended complaint on December 22, 2023 and the case is currently in discovery. Potential class members do not need to take any action at this time. If a class is certified, notice will be provided to class members at that time to the extent required by Rule 23 of the Federal Rules of Civil Procedure.
