Health Insurance Plan of Greater New York (Tanzer v. HIP) Consumer Litigation

Type: Notable Cases

Court: New York Court of Appeals

In a unanimous decision obtained by Wolf Popper, the New York Court of Appeals (the highest Court in New York State) upheld a class action complaint on behalf of insureds who had been denied medical insurance coverage. Wolf Popper subsequently obtained partial summary judgment against HIP for breach of HIP’s contract with its health insurance subscribers for failing to reimburse the subscribers for anesthesia-related expenses in conjunction with surgical procedures performed in New York State since June 7, 1993. Ultimately, a settlement was reached which paid members of the class 100% of their damages.
